Acceptance of Terms

By accessing the Esptek website or engaging our services (Security, Fire, IT, or Communications), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access our website or use our services. These terms apply to all visitors, users, and clients.

Service Agreements and Quotes

All service proposals and quotes provided are estimates based on initial assessments. A binding agreement is formed only upon the signing of a formal contract or the issuance of a purchase order accepted by Esptek. We reserve the right to adjust pricing if the scope of the project changes significantly due to unforeseen technical requirements or client requests during implementation.

Billing and Payment Terms

Invoices for one-time installations or repairs are due upon receipt or completion of work, unless otherwise specified in a separate agreement. Recurring services (such as Managed IT or Monitoring) are billed in advance on a monthly basis. Late payments may be subject to a service charge. Failure to pay may result in the temporary suspension of monitoring or support services.

Client Responsibilities and Access

To perform installations, maintenance, or IT support, the Client must provide Esptek with necessary physical or remote access to the premises and systems. The Client is responsible for ensuring that the installation environment is safe and that necessary power and internet connectivity are available. Delays caused by lack of access may result in rescheduling fees.

Warranties and Equipment

Hardware installed by Esptek is subject to the manufacturer’s warranty. Esptek provides a limited warranty on workmanship for a specific period as defined in your service contract. We do not guarantee that our services will be uninterrupted or error-free, especially in cases of internet service provider (ISP) outages or third-party software failures.

Limitation of Liability

Esptek shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Our liability is limited to the value of the services provided. While we implement robust security measures, we cannot guarantee absolute immunity from all cyber threats or physical intrusions.

Cancellations and Termination

Clients may cancel services by providing written notice as specified in their service agreement (typically 30 days). Early termination of long-term contracts may incur a cancellation fee. Esptek reserves the right to terminate services immediately in cases of non-payment, breach of contract, or unsafe working conditions.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the appropriate courts within this jurisdiction.
